1. We operate by appointment. If we agree to meet you on a
certain day and time, we make every effort to be on time, or to call you if we
cannot be there. We ask that you do the same, so we all avoid wasted time and
trips.
2. DO NOT bring items to consign without calling us first.
We schedule Sellers so that we can provide each Seller with adequate selling
time and table space.
3. All sellers are charged a 20% sellers commission.
4. The Auctioneer determines the order in which items are
auctioned and the amount of time allotted to each Seller. We try to be fair to
all Sellers, but there are priorities involved in the process. At the General
Merchandise auction, top priority goes to high-value items and to our regular
Sellers. If you bring a table full of items, we'll offer your better items
earlier in the auction, and your low-value items later.
5. We reserve the right to limit "box deal"
items, as we don't have time or space for a large number of low-value box
deals. We may not sell box deals at all on bad-weather days.
6. Reserves will be handled on a case by case basis and will be
considered only on a limited basis. Be sure you discuss any reserves with the
auctioneer.
7. You MUST tag all floor items with your Seller
ID and the reserve amount (if applicable). For example: 21R25 indicates Seller
ID 21 and a reserve of $25. If your floor item is not tagged with a reserve
amount the auctioneer may or may not remember that you have discussed a reserve
with him. We will do our best to honor your reserves, however, the Auction
House is NOT responsible if the Auctioneer forgets or otherwise fails to honor
a reserve.
8. Except for Reserve items, you are not required to
tag other items on your assigned table. However, we select about 20 of the best
items at each auction to sell in an early time slot. If your items are not
tagged, we cannot select them for this special slot. So it is to your advantage
to tag your best items.
9. EVERY ITEM SOLD ON THESE PREMISES (inside or outside
the Auction House) is subject to 20% commission, whether or not it is
auctioned. This is a firm rule! If you want to sell something outside the
auction, see the Auctioneer.
10. Although all items are sold AS IS, we DO NOT condone
the consignment of broken or non-working items unless the Seller clearly states
the flaws. It is not acceptable to say you do not know whether an item
works or not. At our discretion, we may terminate your selling rights if
Buyers complain about the quality of your merchandise. If you offer a guarantee
on any item, and the Buyer returns the item to us, the Seller must re-pay the
Auction House the full purchase amount (including your commission).
11. We pay sellers via check on the second business day
after the end of the auction. A large number of our customers pay by credit
card and the credit card companies do not post credits until two business days.
Checks will be mailed to your address of record or you may make arrangements to
pick it up.
12. BOX DEALS MUST BE REMOVED AT THE END OF THE AUCTION.
BOXES NOT REMOVED WILL BE SOLD OR TAKEN TO THE DUMP AND THE SELLER WILL BE
ASSESSED A $10 FEE PER BOX. Unless other arrangements are made with the
Auctioneer, ALL YOUR INSIDE MERCHANDISE MUST BE REMOVED FROM THE AUCTION HOUSE
BY NOON THE DAY AFTER THE AUCTION. Your table must be cleared and
unsold floor items must be removed from the premises. WARNING: We
enforce this rule! If you leave your merchandise, we may sell it or throw it
away. If you cannot take your merchandise with you after the auction, set an
appointment with the auctioneer for pickup. This may sound a harsh policy but
our space is extremely limited.
13. We reserve the right to refuse service to any person,
for any reason, at our discretion. We do not condone disrespectful behavior or
the use of drugs or alcohol.

Rolla Resale Auctions accepts items on consignment to sell
at our weekly auctions. If you are a new seller, please read our Seller Rules first. We
also suggest that you attend one of our auctions to see if this is the right

a note to buyers...
Bidding is fun and easy, but it's important to understand
auction terminology and procedures. If you've never attended an auction before,
please take a minute to read our Buyer Guidelines.
Auction Terms
The following are some basic terms you might want to know when you go
to an auction. Don't worry though, there isn' t a test or anything! Just ask if
you have questions.
Absentee Bid. This is a way that you
can bid even if you cannot attend the auction in person. You can leave a
minimum and maximum bid. We'll bid for you, starting at your minimum and
bidding up to your maximum if necessary. If you are the high bidder, we'll call
you to make arrangements for you to pick up the item.
"As Is". Selling the property
without warranties as to the condition and/or the fitness of the property for a
particular use. Buyers are solely responsible for examining and judging the
property for their own protection. Otherwise known as "As Is, Where Is"
and "In its Present Condition."
Auction Block. The podium or raised
platform where the auctioneer stands while conducting the auction.
"Placing (an item) on the auction block" means to sell something at
auction.
Auction With Reserve. An auction in
which the seller or his agent reserves the right to accept or decline any and
all bids. A minimum acceptable price may or may not be disclosed and the seller
reserves the right to accept or decline any bid within a specified time.
Auction Without Reserve (Absolute Auction). An auction where the property is sold to the highest qualified bidder
with no limiting conditions or amount. The seller may not bid personally or
through an agent.
Auctioneer. The person whom the seller engages to direct,
conduct, or be responsible for a sale by auction. This person may or may not
actually call or cry the auction.
Bid. A prospective buyer's indication or offer of a
price he or she will pay to purchase property at auction. Bids are usually in
standardized increments established by the auctioneer.
Bidder Number. The number issued to each
person who registers at an auction.
Bidder's Choice(or "Choice"). A method of sale whereby the successful high bidder wins the right to
choose from a grouping of similar or like-kind item. . After the high bidder's
selection, a second round of bidding MAY commence, with the high bidder in
round two choosing an item, and so on, until items are sold.
Cashier or Clerk. The person who is
responsible for the accounting and paperwork at an auction sale.
Buyer Premium. A percentage added on to
your bid amount. Buyer premiums are used by many auction houses as a way of
spreading the cost of the event with the people who benefit most from the
opportunity to purchase; the buyer. It is an amount added to the high bid in
addition to the high bid and payable by the buyer.
Commission. The fee charged to the seller by the auctioneer
for providing services, usually a percentage of the gross selling price of the
property established by contract (the listing agreement) prior to the auction.
Estate Sale. The sale of property left by a person at his or
her death. An estate auction can involve the sale of personal and/or real
property.
Hammer Price. Price established by the
last bidder and acknowledged by the auctioneer before dropping the hammer or
gavel.
National Auctioneers Association. An
association of individual auctioneers united to promote the mutual interests of
its members; formulate and maintain ethical standards for the auction profession;
promote the enactment of just and reasonable laws, ordinances and regulations
affecting auction selling; make the public more aware of the advantages of
auction selling; and generally improve the business conditions affecting the
auction profession.
Opening Bid. The first bid offered by a bidder at an auction.
Preview. Be sure to take advantage of the preview times
made available for you to look over the items being offered for sale. Many
times, auction items are slightly used so you will want to know if there are
any defects, such as loose or missing table legs, a vehicle that doesn't start,
or glassware that has chips or cracks. While these may be acceptable to you, it
may affect the amount you want to bid, so look before you bid. You will feel much
more confident if you do this.
Reserve. The minimum price that a seller is willing to
accept for a property to be sold at auction. Also known as the reserve price.
Sales Tax Exemption. If you have a
dealer number for tax exemption purposes, carry it with you when you attend
auctions and show it to the Cashier.
Seller. Entity that has legal possession, (ownership) of
any interests, benefits or rights inherent to the real or personal property.
Types of Payments Accepted. This can
range from cash only to cashier's checks or personal checks and credit/debit
cards. You will need a positive ID such as a driver's license or other
government ID when you register for the first time.
Tie Bids. When two or more bidders bid exactly the same
amount at the same time and must be resolved by the auctioneer.
Times the Money. When the auctioneer is
selling a group of like items, such as four dining table chairs, but is basing
the price on the bid price of one item. For example, you bid on the cost of one
chair, If you win the bid, your total bid is 4 times that amount. You win the
bid at $10.00 times 4 chairs for a total cost of $40.00.
BIDDER RULES
1.
All items are sold AS IS, WHERE IS with no
guarantees of any sort. No Refunds. It is the buyers' responsibility to inspect
all items prior to purchase to ensure its condition and suitability of use for
your purpose.
2.
When the auctioneer cries "Sold" and
you are declared high bidder, you own the item..
3.
Rolla Resale Auctions is not responsible for
theft or damage after the sale.
4.
Rolla Resale Auctions collects Missouri, Phelps
County, & Rolla sales tax, which is computed on your purchase amount.
If a person buying for resale does not present a valid tax exemption
form, sales tax will be charged.
5.
A winning bid creates a legal contract to pay.
You must PAY IN FULL for all purchases at end of auction. We accept cash and
validated credit cards.
6.
We do not HOLD items for pick-up except by
specific agreement. See Jerry or Sandy. Items left on our premises without
notification, or not picked up as agreed, become the property of the Auction
House and may be sold or disposed of.
7.
Every item BOUGHT or SOLD on these premises
(building and parking lot) is subject to commission, whether or not it is
auctioned. Do not buy or sell without notifying the auctioneer, except through
the auction process.
8.
The Auctioneer declares the winning bidder and
price, and his decision is final.
9.
The Auction House reserves the right to refuse
service to any person at our discretion. We do not tolerate disrespectful
behavior or the use of drugs or alcohol on the premises.
10.
Bidder Rules may be amended as required.
Amendments will be announced at the Auction Block during the first auction
following amendment, and a printed copy of the Bidder Rules as amended will be
posted at the Registration Desk.
Buyer Tips
•
PREVIEW the auction! Examine items before they are held up for auction.
Remember, all items are sold AS IS.
•
USE YOUR BID CARD. Hold it up high so the auctioneer sees it. If you want to bid, sit
or stand where the auctioneer can see you. If you still think your bid is not
noticed, YELL! If you want something,
•
BID FOR IT. Do not assume that the seller will pass out items just because you
see he has multiples. He may only serve the high bidder or the high bidder may
buy it all.
•
RESPECT YOUR FELLOW
BIDDERS. Help to hold down loud talking or other
distracting actions. It makes it difficult for the auctioneer and staff to hear
the other bidders and may cause you or another to miss out on something you
really wanted to buy
